La COICA condamne la criminalisation du mouvement autochtone

La Coordination des Organisations Autochtones du Bassin Amazonien (COICA) vient de publier une lettre de soutien à des dirigeants autochtones des Basses Terres de Bolivie contre lesquels  l'Etat bolivien a lancé un mandat d'arrêt pour n'avoir pas répondu à une convocation de la justice suite à l'application de la justice autochtone à l'encontre d'un dirigeant paysan faisant la promotion du projet routier devant traverser le Territoire Autochtone et Parc National Isiboro Sécure (TIPNIS). Ce projet mobilise le mouvement autochtone des Basses Terres depuis plusieurs années et est à l'origine de la rupture de l'alliance politique entre les organisations autochtones du pays et le gouvernement d'Evo Morales.

La Confédération autochtone de Bolivie (CIDOB) a organisé deux marches, en 2011 et 2012, pour tenter de mettre fin au projet. La première fût violemment dispersée par la police dans la localité de Chaparina. Cette intervention avait suscité de nombreuses condamnations tant nationales qu'internationales.

Ce mandat d'arrêt génère un vaste mouvement de solidarité envers les trois dirigeants appréhendés par la justice d'Etat. Des organisations autochtones et des organisations citoyennes veillent sur les locaux dans lesquels se sont réfugiés les trois dirigeants et font barrage à toute intervention policière.

Non à la répression de la CIDOB, de ses dirigeants et de leurs droits

En tant que coordination articulant des confédérations nationales autochtones d'Amazonie de 9 pays sud-américains, la Coordination des Organisations Autochtones du Bassin Amazonien (COICA) condamne la répression politique et le mandat d'arrêt établi à l'encontre des dirigeants amazoniens Adolfo Chávez (président de la CIDOB), Pedro Nuny (Ex vice-président de la CIDOB) et Fernando Vargas (président de la Sous Centrale TIPNIS).

La répression à l'égard du mouvement autochtone amazonien se poursuit. Celle-ci a commencé avec l'imposition d'un projet de route ne bénéficiant qu'aux seuls producteurs de feuilles de coca et destructrice d'un million d'hectares de forêt. Elle s'est poursuivie avec la répression de Chaparina (marche autochtone de 2011 contre le projet de route devant traverser le TIPNIS), puis par la tentative gouvernementale de diviser la CIDOB, l'occupation depuis 2012 de ses locaux par un groupe autochtone de la CIDOB proche du gouvernement, par des actes d'intimidation auprès d'organisations ou de personnes soutenant la CIDOB. Le prétexte donnant lieu à ce mandat d'arrêt est l'application

Le prétexte cette fois est d'appliquer de manière indue la "justice ordinaire" à un cas de « justice communautaire » : le 20 juin, les autorités traditionnelles du TIPNIS (corregidores) réunis en cabildo ont appliqué la justice communautaire inscrite dans la Constitution (paragraphe I, article 190 : « Les peuples autochtones exerceront leurs fonctions juridictionnelles et leurs compétences à travers leurs autorités et appliqueront leurs principes, leurs valeurs culturelles, leurs normes et leurs procédures propres ») et dans la Loi 073 de « Délimitation juridictionnelle. Ces autorités ont jugé le producteur de feuilles de coca Gumercindo Pradel,  opérateur du Movimiento al Socialismo (MAS) et du gouvernement pour avoir négocié des parcelles individuelles dans l'expectative de la route comme il l'avait fait préalablement dans une autre zone du TIPNIS. Le Cabildo l'a sanctionné par quelques coups de fouet et un acte d'engagement à ne plus revenir dans le TIPNIS pour agir contre les organisations autochtones locales. L'accusation de « tentative d'homicide »  présentée par Pradel constitue une fausse accusation. Et le châtiment qui fût le sien n'est rien si on le compare au massacre (sic) de Chaparina de dizaines de femmes, d'hommes, d'enfants, d'adultes frappés, blessés, gazés et humiliés durant la répression de la 9ème marche de la CIDOB en défense du TIPNIS.

Les principes légaux qui octroient une égalité hiérarchique entre la justice autochtone et la justice ordinaire sont violés. Alors que le cas Chaparina reste impuni depuis deux ans, dans le cas Pradel, les mandats d'arrêt à l'encontre des dirigeants de la CIDOB ont été émis en 7 jours.  L'Ombudsman lui-même a signalé l'intromission politique et le non-respect de la justice autochtone et que le Tribunal Constitutionnel était la seule entité compétente étant en mesure d'examiner éventuellement le cas Pradel pour déterminer si ce dernier relevait de la justice autochtone ou de la justice ordinaire.

Nous travaillons actuellement à l'organisation d'une mission diplomatique autochtone internationale cherchant le dialogue avec le Président Evo Morales pour que cesse l'injuste persécution de la CIDOB. Nous invitons Mirna Cunnigam, la Présidente du Forum Permanent des Peuples Autochtones à l'ONU ; Gerardo Jumi, le Coordinateur général de la Coordination Andine des Organisations Andines (CAOI) ; Humberto Cholango, Président de la Confédération Nationale Autochtone d'Equateur (CONAIE) ; Adolfo Pérez Esquivel, Prix Nobel de la Paix et d'autres personnalités internationales à se joindre à cette mission.

Nous demandons le dialogue, la pacification et une solution politique parce que cette répression est inutile. La CIDOB résistera. La solidarité avec le TIPNIS ne va cesser de croître tout comme le rejet mondial face au refus d'engager un processus de décolonialité de l'État et de Plurinationalité inscrites dans une longue histoire des luttes autochtones et populaire en Bolivie.

Pour la Défense du TIPNIS, de l'Amazonie, de la justice autochtone et de la Constitution Plurinationale de Bolivie !

Bolivia: Criminal Charges Against Indigenous Leaders, Revelations of Police Infiltration Reignite TIPNIS Conflict

On August 6, the 188th anniversary of Bolivian independence, a traditional day of festive celebration was transformed into an act of protest [3] by indigenous groups in the Amazonian department of Beni, who demonstrated in the capital city of Trinidad with hands tied behind their backs and mouths covered with masking tape.

Credit: El Dia.The episode reflects renewed tensions over President Evo Morales's proposed construction of a highway through the TIPNIS indigenous territory and national park, as indigenous leaders face serious criminal charges over a recent community altercation.  Adding fuel to the fire, the government has recently aroused indignation by confirming that undercover police agents infiltrated the landmark 2011 anti-highway mobilization.

Anti-highway leaders Adolfo Chávez, Fernando Vargas, and Pedro Nuni are currently facing judicial orders of detention for alleged criminal acts, including attempted homicide and femicide. The accusations stem from an incident [4] last June 22 in the TIPNIS community of San Pablo de Isiboro, when Gumercindo Pradel, an indigenous leader who supports the road, was subject to a public community whiplashing.

Pradel, president of the indigenous authority CONISUR, represents government-allied factions in the southern portion of the park, mostly outside the collective land title, who are bitterly at odds with groups opposed to the road. The conflict between pro- and anti-highway sectors within the TIPNIS has intensified since the government's controversial consultation process [5] last year, which failed to reach consensus.  Several other CONISUR supporters were injured in the course of the confrontation, including a pregnant woman who subsequently aborted, providing the basis for the femicide [6]charge.

Pradel was allegedly in the process of convening an illegitimate assembly [7] in the TIPNIS, with the intention of ousting Vargas and other directors who participated in the anti-highway marches of 2011 and 2012.  Similar tactics have recently been used to divide the lowlands indigenous federation CIDOB, the Secure Subcentral indigenous authority within the TIPNIS, and other groups that are resisting the highway.1959 Community confronts Pradel (center). The decision to punish Pradel, Vargas argues, was made democratically by consensus of the community assembly, in accordance with principles of traditional community justice [8] that are recognized by the Bolivian Constitution.  In addition to receiving his public punishment, Pradel was forced to sign a statement—which he later revoked—renouncing any further involvement in the affairs of the indigenous territory and his advocacy of the TIPNIS highway.  

The three leaders have refused to appear in court, considering their case to be outside the jurisdiction of the ordinary justice system.  Nuni and Chávez have denied being physically present at the incident in San Pablo, although they are accused of being the "intellectual authors" of the alleged crimes.

Supporters of the TIPNIS leaders defend their right to resist what they regard as a criminalization of protest.  Ex-human rights ombudsman Waldo Albarracín [8] argues that the practice of community justice to resolve internal disputes is consistent with tradition inside the TIPNIS.  In 2009, he notes, Marcial Fabricano, ex-leader of CIDOB, was whiplashed by the community for allegedly betraying the collective trust, with no subsequent intervention by the courts or the government.

Credit: SomosSur.Since July 10, the 3 leaders have taken refuge at the headquarters of the TIPNIS Subcentral in Trinidad, protected by a round-the-clock vigil of indigenous supporters. Evidencing the new political alignment in Bolivia's eastern lowlands, on July 23 a civic strike [9] was convoked in solidarity by the Beni Civic Committee and local unions, with support from the current and former opposition governors of Beni and the Santa Cruz Civic Committee.  Historically, these opposition groups were allied with the conservative, pro-autonomy—and anti-indigenous—forces that rebelled against Morales in 2008.

The strike effectively shut down business in Trinidad for the day. The Beni Civic Committee has declared the defense of the TIPNIS to be its current regional priority [10].

Supporters of the TIPNIS leaders have contrasted the unprecedented swiftness of the justice system in bringing charges in this case with the snail's pace of the investigation into the police repression [11] of indigenous TIPNIS marchers at Chaparina nearly 2 years ago, for which no one has yet been formally charged or held accountable.

Meanwhile, government officials have identified an undercover female police agent who infiltrated the march and was present during the alleged "kidnapping" [11] of foreign minister David Choquehuanca the day before the Chaparina incident. The agent subsequently received a commendation for her efforts.  Based on video evidence, TIPNIS leaders charge that she acted as a provocateur, [12] inciting the aggression against Choquehuanca that precipitated the police repression.  The government denies these allegations, while confirming [13]that undercover agents were widely utilized during the TIPNIS marches and other recent mobilizations as a "preventive" measure.  The case is under investigation.1961 Police infiltrator and alleged provocateur (right). The embattled TIPNIS leaders are now seeking a ruling from the Plurinational Constitutional Tribunal, Bolivia's highest court, to determine the applicability of community vs. ordinary justice to the charges pending against them.  Their efforts are supported by UN Human Rights representative Dennis Racicot [14], who has criticized the actions taken against Pradel from a human rights perspective, while arguing that the respective jurisdictions of the two justice systems established by the Constitution must be clarified.

Officially, the Morales government has sought to distance itself from what it characterizes as an unfortunate inter-community conflict.  "While others are fighting in the dirt down in Trinidad," Vice President Alvaro García Linera recently lamented [15]at a ceremony delivering public works to communities in the TIPNIS, "we are building a new school for children."

But critics hold the government squarely responsible for failing to resolve, if not exacerbating, the TIPNIS conflict.  As ex-deputy Guillermo Richter [16] recently noted, "To not have carried out the consulta at the proper moment, unfortunately, has brought us to this situation of permanent conflict.  (The government) has not responded or offered an alternative solution, which can't be other than dialogue."

Still, the government's much-criticized handling of the consulta, including its practice of distributing benefits to TIPNIS communities while soliciting their unbiased views on the proposed highway, has had some ironic consequences.  As TIPNIS leaders have noted, the outboard motors and telecommunications systems delivered to many communities were critical in getting their representatives to San Pablo last June to resist Pradel's attempted takeover.   "The motors that they gave us," says Fernando Vargas [17], "are helping to us mobilize the struggle in defense of our territory."

Dirigentes del TIPNIS pidieron asilo político

Los tres dirigentes del TIPNIS implicados en el caso Pradel pidieron asilo político en algunas embajadas radicadas en el país. Con este recurso, informó el dirigente indígena Rafael Quispe, se pretende evitar que sean detenidos por la Fiscalía.

"Ya hemos enviado las solicitudes; hasta que no haya una respuesta no vamos a decir el nombre de ninguna embajada", informó Rafael Quispe, responsable de Fortalecimiento Político de la Coordinadora Andina de Organizaciones Indígenas (CAOI).

El dirigente indígena aseguró que la medida protegerá a los dirigentes de las órdenes de aprehensión que tienen en contra."Hasta el momento (los dirigentes) están en Trinidad protegidos por los pueblos y no van a salir; parece que el Gobierno quiere jugar al desgaste y esto se ve en la persecución política que hacen con ellos; por eso vamos a ver que los hermanos se asilen en alguna embajada", afirmó el representante indígena.

Si alguna embajada acepta el asilo a los dirigentes, apunta Quispe, se afectará la imagen política de la administración del presidente Morales. "Si aceptan el asilo, puede ser un gran golpe al gobierno del MAS,  la imagen internacional puede caer".

En julio, la Fiscalía de Beni emitió órdenes de aprehensión contra Adolfo Chávez, Pedro Nuni y Fernando Vargas, acusados de haber golpeado al también dirigente Gumercindo Pradel en la comunidad San Pablo, en el Territorio Indígena Parque Nacional Isiboro Sécure (TIPNIS).

El miércoles 14 está prevista una nueva audiencia en el caso. "Tenemos entendido que la próxima audiencia va a ser el miércoles en la ciudad de Trinidad", anunció Melva Hurtado, dirigente de un sector de la Confederación de Pueblos Indígenas de Bolivia (Cidob). Espera que en esta  cita se avance sobre el caso.Justicia. Sobre la audiencia, Quispe reiteró la posición de los dirigentes acusados de no acudir a dicha convocatoria,  "no van a asistir a ninguna audiencia, ellos van a seguir ahí dentro del TIPNIS".

El representante indígena sostiene que los dirigentes del TIPNIS estarán refugiados en Trinidad hasta que el Tribunal Constitucional se pronuncie sobre la jurisdicción correcta a la cual deban someterse.

"Pedimos el recurso de incompetencia, porque la justicia ordinaria es la que ha emitido el mandamiento de aprehensión; (cuando) creemos que es competencia de la justicia originaria, este tema lo resolverá el Tribunal Constitucional", añadió.

Para definir la jurisdicción adecuada, la Ley 073, de Deslinde Jurisdiccional, determina los mecanismos de coordinación entre la justicia indígena originaria y la justicia ordinaria.
